Council of State Administrative Courts Issued An Injunction Decision Regarding EMRA’s 498.7mn YTL

In the lawsuit POAŞ filed for the annulment and stay of execution of the administrative fine imposed upon POAŞ by the Energy Market Regulatory Authority, the Istanbul 7th Administrative Court has ruled for the denial of the motion for stay and POAŞ has filed an objection with the Istanbul District Administrative Court for the reversal of this decision.

After reviewing POAŞ application, with its Resolution No: 2007 / 344 dated 31.01.2007 the Istanbul District Administrative Court has ruled for the acceptance of the objection, as well as their request for the stay of execution without a guarantee after the annulment of the decision of the Istanbul 7th Administrative Court for the denial of the request for stay.

The subject decision has been submitted to the relevant Tax Office by the Company and the second installment of the fine due has not been paid due to the suspension of the payment order.
